Creating a Lasting Power of Attorney

A Lasting Power of Attorney allows you to appoint a person or people to make decisions for you. There are two different types of Powers of Attorney, Finances and Health. Your Attorney can act of you are no longer able to make decisions yourself. In the case of the Lasting Power of Attorney for Finances, you can also instruct your Attorney to make decisions for you even if you are able to make decisions yourself.

The benefit of creating a Lasting Power of Attorney is that you have control to decide who you appoint. The decisions that you allow your Attorney to make can be tailored to suit your circumstances.

Registration of a Lasting Power of Attorney/Enduring Power of Attorney

A Lasting Power of Attorney must be registered with the Office of the Public Guardian before it can be used.

It is no longer possible to create a new Enduring Power of Attorney, but those made and signed before October 2007 can still be used. Where a person is or is becoming incapable of managing their affairs; we can assist you in applying to the Office of the Public Guardian to register the Enduring Power of Attorney.
